ABUNDANCE GARDENING LLC – CUSTOMER SERVICE AGREEMENT & TERMS OF SERVICE

Client: The individual or household receiving service (“Client”)

1. SERVICE OVERVIEW
Abundance Gardening LLC provides custom produce garden installation and maintenance through subscription-based packages. Clients may choose from the following:
1.1 Harvest Lite

Setup Fee: $249 (one-time, non-refundable)

Monthly Fee: $125

Up to 10 breathable fabric grow bags

Custom organic soil + heirloom seeds
-
Weekly on-site maintenance (Fri–Sun)
1.2 Backyard Bounty

Setup Fee: $349
-
Monthly Fee: $150
-
Two raised mobile beds with self-watering reservoirs
-
Soil and seed customization
-
Weekly service included
1.3 Indoor Oasis
-
Setup Fee: $799
-
Monthly Fee: $175
-
Includes one Rise Garden hydroponic system

Indoor install, calibration, and nutrient management
-
Weekly service included
Client must confirm selected plan prior to scheduling.
2. SERVICE SCHEDULE
-
Services occur weekly between Friday and Sunday.
-
Provider must have uninterrupted access to the garden area.
-
Missed visits due to inaccessibility will not be rescheduled and are still billable.
3. PAYMENT TERMS
-
Setup Fee: Paid in advance before installation. Non-refundable.
-
Monthly Fee: Billed each month.
-
Late Fee: $25 assessed after 5-day grace period.

Suspension for Non-Payment: Services are paused after 10 days overdue.
-
Collections: Accounts >30 days overdue may be referred to collections. Client is liable for recovery costs.
4. MINIMUM TERM & CANCELLATION

All plans require a minimum 3-month commitment.

Early cancellation will result in a fee equal to the unpaid balance for 3 months of service.

After 3 months, cancellation requires 14 days written notice. No partial-month refunds are given.
5. OPTIONAL CROP PROTECTION INSURANCE ($5/month)
This add-on covers up to 10 monthly crop replacements due to:

Weather damage
-
Pest/animal interference
-
Environmental failure
-
Client error
Damage must be reported within 72 hours. Does not cover intentional misuse.
Crops lost due to Provider error are replaced regardless of insurance status.
6. 100% GERMINATION GUARANTEE
Abundance Gardening guarantees 100% germination on all initially planted crops.

If any crop fails to germinate under standard conditions, it will be replaced at no cost.

Applies only to crops planted and maintained by Provider.

Does not apply to customer-interfered beds or soil.
This guarantee reinforces our commitment to performance, health-conscious results, and maximum food yield.
7. CLIENT RESPONSIBILITIES
Client agrees to:

Provide safe, consistent access to the garden system
-
Avoid tampering with or relocating equipment without permission
-
Report issues within 72 hours of observation
-
Maintain general cleanliness and absence of hazards
-
Control pets and obstructions during visit hours
8. LIABILITY & HOMEOWNER’S INSURANCE
Provider is not liable for any damage to Client’s property caused by weather, plant roots, pests, animals, or structural changes related to garden systems.

Client agrees that any damage to home, yard, structures, or property arising from installation, irrigation, system failure, or normal use is not the responsibility of Provider.

All damage or loss shall be handled through Client’s homeowners insurance.

Client waives any right to claim damages from Provider except in the case of gross negligence or intentional misconduct.
Examples not covered include:

Root intrusion in lawn or ground
-
Water pooling near foundations
-
Plants or planters blowing over in high winds
-
Indoor systems affecting flooring or electronics
-
Animal-attracted garden issues
9. INTELLECTUAL PROPERTY

All designs, systems, content, and methods used are proprietary.

Client may not reproduce, license, or distribute them commercially.

Testimonials and garden photos that do not identify the client or their location may be used by Provider unless Client opts out in writing.
10. TERMINATION BY PROVIDER
Provider reserves the right to deny or terminate service for:

Unsafe or hostile conditions
-
Payment delinquency
-
Equipment tampering
-
Violation of this agreement
- Any other legal reason
Client is liable for all balances and costs incurred.
11. GOVERNING LAW & DISPUTES
This agreement is governed by the laws of Florida.
All disputes will be settled through binding arbitration in Brevard County, Florida, per AAA rules.
12. SEVERABILITY & ENTIRE AGREEMENT
If any part of this agreement is deemed unenforceable, the remainder shall remain valid.
This document represents the full, binding agreement between Client and Provider. No oral modifications shall apply.
